Creative plaintiffs’ attorneys — and the litigation risks they generate — thrive where laws and regulations remain undeveloped and gray. After largely harvesting the field of ADA Title III website accessibility claims, many of these attorneys have shifted to a new category of website “gotcha” litigation: claims under California’s Invasion of Privacy Act (CIPA) based on the operation of cookies and pixels, increasingly coupled with a reemergence of ADA claims.
